A certified translation (sometimes called an official translation, certified translation, or a translation with a round stamp, etc.) is a type of document translation required mainly by authorities (both Czech and foreign) and other institutions. Certified translation is most often required for documents such as diplomas, birth and marriage certificates, criminal records, etc. Only a translator who has been appointed by the court to make court translations can make the translation.
The certified translation must always be inextricably linked to the translation and must be certified, signed and sealed by the translator. Most often the translation is tied with a three-colour string, but it can also be stapled together with a stapler, etc. The interpreter's clause confirms that the interpreter (translator) has been appointed by the court to make the court translation - it also indicates when and which court appointed the interpreter, as well as the number under which the translation is entered in the interpreter's logbook of the interpreter who made the translation. As the binding of the translation should be inseparable, it is recommended that a notarial copy be provided instead of the original document for certain important documents (diplomas, birth certificates, etc.).
The details are described in Ministry of Justice Decree No. 37/1967 Coll., on the implementation of the Act on Experts and Interpreters.
(i.e. attaching a certification clause, the so-called apostille) Apostille is the certification of a public document for the purpose of use abroad or so-called higher certification. With an apostille, the authority of the state (in the Czech Republic, the Ministry of Justice of the Czech Republic and the Ministry of Foreign Affairs of the Czech Republic) where the document was issued confirms its authenticity. The process of obtaining this certification is simpler than in the case of super legalization. However, the apostille can only be used in contacts between states that are contracting states to the Hague Convention of 5 October 1961 on the Abolition of the Requirement of Authentication of Foreign Public Documents. That Convention has removed the requirement of super-legalization between the Contracting States and replaced it with a special clause called an apostille. The authentication of the instrument by the embassy of the State in which it is to be used is thus abolished.
As in the case of super-legalization, the higher certification (here apostille) is attached to the document only after the document has been certified by a governmental authority superior to the authority that issued the document (e.g. a certificate issued by a school bears the stamp of the Ministry of Education and Sports of the Czech Republic). Only then is the document certified by an apostille.
